Decree-Law No. 91/2024: The New Era of Electronic Notifications possible in Portugal

Electronic notifications from public authoritiesand citizens will have legal validity in Portugal. 

They are considered received when consulted or, in the absence of consultation, at the end of the fifth day following the registration of their availability in the IT system supporting the electronic notification service. These notifications will be made available through a digital platform, the website https://tribunais.org.pt, gerido pelo IGFEJ, I.P.(1) , managed by IGFEJ , which ensures data security and protection in compliance with the General Data Protection Regulation - GDPR (2) 

AMA (3), registers an email address for electronic notifications and links the address to the recipient through interoperability.3)Notifications will be sent via the digital platform to recipients who have registered their email without needing a handwritten signature and validated through electronic authentication mechanisms. 

The PERTO system, used to send notifications to institutions supervised by the Bank of Portugal, ensures communication and responses from these entities.  

Access to the platform is made via the BPnet system, which guarantees the security and privacy of information and retains records for 30 days. The Bank of Portugal and the responsible entities define the technical specifications for interoperability.  

Finally, a phased implementation schedule for the system will be established in the first six months, allowing public entities and users to adapt to the new rules. During the transition, both paper and digital notifications will be allowed to coexist, accompanied by awareness campaigns.
