Road Traffic Offence Amnesty: Learn About Law no. 38-A/2023

Law no. 38-A/2023, published on the 2nd of August, 2023, established a pardon of sentences and an amnesty for infractions, on the occasion of the World Youth Day in Portugal, which came into force on the 1st of September, 2023.

Serious and very serious road traffic offences, to which additional penalties have been applied, such as driving disqualification and vehicle seizure, are forgiven to all drivers, regardless of age to offences that have been committed until 12 a.m. on the 19th of June, 2023, and if the maximum applicable fine does not exceed a thousand euros.

The amnesty is only applied to additional penalties, meaning that the payment of traffic fines remains mandatory, whether they are minor, serious, or very serious infractions. Despite the amnesty, the registration of the infraction in the Driver's Infractions Record (RIC) and the loss of points on the driving license continue to be registered.
